E-Bike Compliance & Intended Use

1. The two classifications
1.1 Pedelec / EN-Legal (up to 250W)
Bikes built with our 36V 250W Bafang motor + 20Ah battery configuration comply with the European standard EN 15194:
- Maximum continuous motor power: 250W.
- Motor assistance cuts out at 25 km/h.
- Motor only engages while the rider is pedalling.
These bikes are classified as pedal-assist bicycles in all Australian states and territories and may be ridden on:
- Public roads (subject to local cycling rules).
- Bike paths.
- Shared paths.
- Other places where regular bicycles are permitted.
No motor vehicle registration, licence, or insurance is required for these bikes. An approved helmet is mandatory in all Australian states and territories.
1.2 Above 250W — Motor vehicle classification
Bikes built with our higher-power configurations (for example 48V 750W or 52V 1000W Bafang/Hentach motors) do not meet the EN 15194 pedelec standard. Under Australian law, these bikes are classified as motor vehicles when their output exceeds 250W continuous power or when motor assistance is available above 25 km/h.
This means:
- They are not legal to operate on public roads, bike paths, or footpaths.
- They cannot be registered as a road-going vehicle in their current configuration.
- They are intended for use on private land, private property, or designated off-road areas only.
- Using one on a public road may result in fines, demerit points, vehicle impoundment, and criminal charges depending on your state.
2. State-by-state variation
While the federal vehicle standards are consistent, each state and territory enforces them through its own road rules. Penalties, registration definitions, and helmet requirements vary. Before riding, check your local rules:
- QLD — Transport Operations (Road Use Management—Bicycles) Regulation 2009 (qld.gov.au).
- NSW — Road Transport Regulation 2017 (nsw.gov.au).
- VIC — Road Safety Road Rules 2017 (vicroads.vic.gov.au).
- WA — Road Traffic Code 2000 (transport.wa.gov.au).
- SA, TAS, NT, ACT — refer to each state's transport authority.
3. Rider age and licensing
We require all purchasers to be at least 16 years of age and to hold a valid Australian learner's licence (or higher driver licence). This is a condition of sale, not a legal requirement to ride an EN-legal e-bike, and reflects our responsibility as a manufacturer of high-value electric mobility products.
Children under 16 may ride EN-legal pedelecs in some states with parental supervision under their state's cycling laws — but we will not sell directly to anyone under 16.
4. Helmet and safety
A certified bicycle helmet (Australian Standard AS/NZS 2063) is mandatory for all riders, all ages, in all states and territories of Australia. Front and rear lights are mandatory at night. We strongly recommend high-visibility clothing.
5. Insurance
Comprehensive bike insurance is not legally required for EN-legal pedelecs but is strongly recommended given the value of your custom build. Public liability cover is sometimes included in home and contents policies — check with your insurer. For off-road use of >250W builds, ensure you have appropriate cover.
6. Your acknowledgement
By purchasing from Oceanside Electric you acknowledge that you have read and understood this Compliance Statement, you accept full responsibility for legal and safe use of your bike, and (where applicable) you accept the restriction to private land or off-road use for any build exceeding 250W of motor power.
