Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and OSB Trade Pty Ltd (ABN 75 657 616 450, ACN 657 616 450), trading as Oceanside Electric ("we", "us", "our"). By reserving, purchasing, or using our products and services you accept these Terms in full. If you do not accept them, do not place an order.
1. Who can purchase
To reserve or purchase a custom e-bike, you must:
- Be at least 16 years of age.
- Hold a valid Australian learner's licence (or higher driver licence).
- Have the legal authority to enter into this agreement.
- Provide accurate, current, and complete information during the reservation and payment process.
We may refuse, cancel, or limit any order at our discretion, including where we suspect the eligibility criteria are not met.
2. The configurator and your build
Our online configurator lets you design a custom e-bike spec — paint, components, accessories. The 3D rendering is a close visual approximation. Final colour, finish, and component appearance may vary slightly due to materials, lighting, and manufacturing tolerances. We will discuss your build with you by phone before production begins to confirm your spec.
3. Reservations
Submitting the reservation form is an expression of interest. It does not constitute payment. We will contact you within 24 hours of receiving your reservation to confirm your spec, answer questions, and arrange payment of the deposit. We hold your reservation slot for seven (7) days from submission. If we have not received your deposit within that window we may release the build slot.
4. Payment structure
- Deposit: 50% of the total bike price, payable to confirm your order and commence production. Calculated based on the spec at time of reservation.
- Balance: the remaining 50% plus DDP shipping, payable before your bike is dispatched. We will notify you when your bike is ready to ship; balance is due within fourteen (14) days of that notification.
- Payment methods: credit/debit card, Stripe, or bank transfer (BACS) as displayed at checkout.
- All prices in AUD unless otherwise stated, inclusive of GST where applicable.
5. Custom-order nature — deposit non-refundable
Each bike we sell is manufactured to the unique spec you design. Once you confirm your build and we begin production, the materials, paint, and components are committed to your order and cannot be reused for another customer.
Accordingly, your deposit is non-refundable once production begins. This is the standard practice for genuinely custom-manufactured products under Australian Consumer Law (ACL). It does not affect your rights under the statutory consumer guarantees in sections 54–59 of the ACL (see section 9).
5.1 Failure to pay the balance
If you do not pay the balance within fourteen (14) days of being notified that your bike is ready to ship, you will be in default of this agreement. We reserve the right to:
- Retain your deposit in full to cover the costs of production and the slot you took.
- Resell the completed bike to another customer to mitigate our loss.
- Cancel the order without further notice.
5.2 Cancellation by you before production starts
If you change your mind before we begin production, contact us immediately. We may, at our discretion, refund all or part of your deposit less reasonable administrative costs already incurred. We are not obligated to do so once your spec has been confirmed to the factory.
5.3 Cancellation by us
If we cancel your order before production begins (e.g. supplier issue, component unavailability), we will refund your deposit in full.
6. Delivery
Expected build time is six to eight (6–8) weeks from deposit to your door, including DDP shipping. Delivery times are estimates and may vary due to manufacturing schedules, customs, and shipping logistics. We will keep you informed of any material delays.
Title and risk in the bike pass to you on delivery. You must inspect the bike on arrival and notify us within seven (7) days of any visible damage or defect.
7. Eligibility, registration, and intended use
It is your responsibility to ensure that your selected bike spec is legal to use in the way and the location you intend. See our E-Bike Compliance Statement for detail.
For builds with a motor rated above 250W:these bikes do not meet the EN15194 pedelec standard and are classified as motor vehicles in Australia. You must use these only on private land or designated off-road areas. You must NOT use them on public roads, bike paths, or footpaths. By purchasing a >250W build you acknowledge and accept this restriction in full and indemnify Oceanside Electric from any liability arising from your non-compliant use.
8. Warranty
Our bikes carry a two (2) year limited warranty on the frame and one (1) year on electrical components (motor, battery, controller, display) against manufacturing defects, in addition to your rights under the ACL. Warranty does not cover:
- Normal wear and tear (tyres, brake pads, chain, etc.).
- Damage from accident, misuse, modification, or unauthorised repair.
- Cosmetic wear from regular use.
- Damage from use outside the bike's legal classification (e.g. operating a >250W build on public roads).
- Water damage from submersion or pressure washing.
9. Statutory consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

10. Intellectual property
All website content, configurator interface, designs, photography, copy, and branding are owned by Oceanside Electric or our licensors. Your build configuration (the unique combination of paint, components, accessories you design) is yours to use, share, and modify. The underlying 3D models, configurator code, and brand assets remain ours.
11. Indemnity
You agree to indemnify and hold harmless Oceanside Electric, our directors, employees, and contractors from any claim, loss, damage, or cost arising from:
- Your breach of these Terms.
- Your use of the bike contrary to its intended legal classification.
- Your provision of false or misleading information.
- Your unlawful or negligent use of the bike or related products.
This clause does not apply to the extent prohibited by law.
12. Liability cap
To the maximum extent permitted by law, our total liability for any claim arising out of or in connection with these Terms or your purchase is limited to the amount you paid for the bike. We are not liable for any indirect, consequential, or special loss. This clause does not limit your rights under the ACL.
13. Force majeure
We are not liable for delay or failure to perform our obligations if caused by events outside our reasonable control — including natural disasters, pandemics, war, government action, supplier failure, freight disruption, or industrial action.
14. Governing law and disputes
These Terms are governed by the laws of Queensland, Australia. Any dispute will be resolved in the courts of Queensland. Before commencing any proceeding you must give us thirty (30) days' written notice and a reasonable opportunity to resolve the issue.
15. Changes to these Terms
We may update these Terms from time to time. The version that applies to your order is the one in effect at the time you submitted your reservation. Material changes will be communicated by email or via the website.
